Data Subject Application Form

For requests under Article 11 of the Personal Data Protection Law No. 6698.

This form has been prepared to assist in submitting requests under Art. 11 of the Personal Data Protection Law No. 6698. Use of the form is not mandatory: any application containing the information required by the Communiqué on the Procedures and Principles of Application to the Data Controller will be assessed. This English text is a courtesy translation. In the event of any discrepancy, the Turkish version prevails.

III. Your Relationship with KST Law & Consultancy

The nature of your relationship must be stated so that your application can be assessed correctly. If you are an employee, former employee or job applicant, please also give your job title and the period of your employment. If you are an employee of a supplier or client entity, please give the name of the organisation and your position.

IV. Subject of the Request

Tick the box beside the right or rights you wish to exercise. Stating the subject of the request is mandatory under the Communiqué. If you are requesting rectification, attach the information you consider inaccurate or incomplete together with documents showing the correct information. If you are claiming compensation, attach information and documents explaining the loss suffered and its connection to the processing of your personal data.

Collection of the response in person by a representative requires a special power of attorney executed before a notary.

VII. Information on the Assessment of Applications

Applications are concluded free of charge as soon as possible and in any event within thirty days, according to the nature of the request, under Art. 13/2 of Law No. 6698. Where the process entails an additional cost, the fee in the tariff determined by the Board may be charged. Under the Communiqué on the Procedures and Principles of Application to the Data Controller, where the response exceeds ten pages a processing fee of 1 Turkish lira may be charged for each additional page. Where the response is provided on a storage medium, the cost of that medium may be charged. If the application arises from an error of the data controller, any fee charged is refunded.

Where an application is rejected, the response is considered insufficient, or no response is given within the period, the data subject may lodge a complaint with the Personal Data Protection Board under Art. 14 of Law No. 6698 within thirty days of learning of the response and in any event within sixty days of the date of application. A complaint cannot be lodged with the Board before the application route to the data controller has been exhausted.

Additional information and documents may be requested in order to establish identity and authority. This serves to prevent unlawful data disclosure and to protect the security of your personal data. Where the information in an application is inaccurate or not current, or where an unauthorised application is made, no responsibility is accepted for the resulting consequences.

The personal data you provide in this form are processed solely in order to assess and respond to your application, on the ground at Art. 5/2-ç of Law No. 6698 that processing is necessary for the data controller to fulfil a legal obligation, and are retained for the period prescribed by legislation.
